Decree 45/2013/ND-CP dated may 10th 2013 by government guiding specific points of labour code about working time and recreation hours and labour safety, labour hygiene
Under the provisions of Decree No. 45/2013/ND-CP:
• Time is calculated in terms of working time to be paid include:
- Time off between working hours is considered working time applicable to continuous 08-hour shifts in normal conditions or 06 hours in the case is shortened. Their specified time is decided by the employer.
- In addition to break time in the normal work shift, employees working 10 hours or more days, including the overtime hours they are entitled to at least 30 minutes during the working day.
- Time to stop work is not the fault of the employee.
• The number of overtime hours in the day are as follows:
- No more than 50% of the normal hours of work in 01 days, when the regulations applicable work week, the total number of normal working hours and overtime hours shall not exceed 12 hours in 01 days
- No more than 12 hours in 01 day when they work overtime on holidays holidays and weekends.
- Overtime from more 200 hours to 300 hours in a year such as production, processing export products are textiles and clothing, leather, footwear, processed agricultural, forestry and fisheries.
